An extended Mishnah?
I discussed this phenomenon once in the past, where there might be an extra bit of Mishnah.
Perhaps we see this phenomenon in Bava Batra 168, where our Mishnah clearly ends:
and indeed, the next Mishnah brings up a new and separate topic.
Then, in the gemara, a brayta / Tosefta is cited for the case in which a document is ripped, and the gemara that discusses it.
However, looking at two Talmudic manuscripts, it seems like this statement has been included in the Mishnah itself! Thus, in the Escorial manuscript, we have this statement delineated in red lines:
This could not possibly be gemara, because the way the Escorial manuscript works is that it lists all the Mishnayot first, all together, and then the gemaras. So, what follows is the next Mishna, in the entirely Mishnaic section.
We find almost the same in the Hamburg 165 manuscript. Again, this is the entirely Mishnaic section that precedes the gemara. I underlined the end of our Mishnah. And, some scribe has copied this Mishnah or brayta into the margin, because he believes that it is a Mishnaic text that belongs right there.
